On Friday, February 9, 2024, from 11:00-11:30 AM Eastern, Eric Dinallo of the Insurance Regulatory Group, and Avi Gesser and Sharon Shaji of the Data Strategy & Security Group, hosted a discussion on the NYDFS Proposed AI Insurance Circular Letter that was released on January 17, 2024, which sets out detailed requirements for insurance companies operating in New York that use AI or external data relating to board and senior management oversight, policies, risk assessments, transparency, auditing, bias testing, documentation, and vendor management. We discussed:

  • the scope of the proposed Circular Letter;
  • how the testing requirements might work in practice;
  • how these requirements compare with other AI insurance regulations; and
  • areas that should be addressed through the comment process
